EXCEPT AS PROHIBITED BY LAW, YOU AGREE TO HOLD SMVD MARINE ACADEMY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FROM ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, HOWEVER THEY MAY ARISE, INCLUDING ATTORNEYS’ FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION OR ARBITRATION, WHETHER ARISING FROM AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR IN CONNECTION WITH THESE TERMS, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE SERVICE OR ANY VIOLATION BY YOU OF APPLICABLE LAWS, RULES, OR REGULATIONS, EVEN IF SMVD MARINE ACADEMY HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
EXCEPT AS PROHIBITED BY LAW, IF ANY LIABILITY IS FOUND ON THE PART OF SMVD MARINE ACADEMY, SUCH LIABILITY SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE PRODUCTS AND/OR SERVICES. UNDER NO CIRCUMSTANCES SHALL SMVD MARINE ACADEMY BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES.
THE FOREGOING LIMITATIONS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND SHALL NOT AFFECT ANY LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
13. Termination
We may terminate or suspend your enrollment with SMVD Marine Academy immediately, without prior notice or liability, at our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.
If you wish to terminate your account, you may simply discontinue using the Service.
All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and SMVD Marine Academy regarding your use of the Service and supersede and replace any prior agreements or understandings regarding the Service.
